ASSAULT

As a so-called person crime, assault charges are treated more seriously than many other charges.  Often times, a person arrested for assault is booked into custody and brought before a judge the next business day.  This is particularly true for a domestic assault or a felony assault charge.  Sometimes though a person charged with a minor assault charge may be given a citation or release agreement to appear in custody a few weeks down the road.

If you are charged with assault in the second degree or assault in the first degree, you will likely have a very high bail, because these are Measure 11 offenses.  If you are unable to post bail, your attorney may be able to set a bail reduction hearing in an attempt to get a judge to lower your bail.


If you are released from custody after your arrest (whether on bail or on your own recognizance), be sure to read, understand, and obey any release agreement or release conditions.  This is especially true of any "no contact" order.  Do not have contact, direct or indirect, with the complaining witness in your case or you risk being taken into custody.  This can be difficult if the complaining witness is your spouse or significant other, but it is critically important.  Your attorney may be able to request the judge to modify the no contact order at a later time.



Rules for hitting people:



* Self defense = reasonable force to get away, Not Fighting (“He hit me first” or “He started it” is not a defense, it simply means both of you go to jail)
* Police will always put the greatest threat in custody (AKA the football player)
* Beware of people who try to “push your buttons” (male and female)
* Walk away!
You are responsible for your own behavior. Violence is against the law, punishable by up to 30 years in prison and very embarrassing to your team and family. Think before you act!



Arrest Warrants Issued For LSU QB

BATON ROUGE, La. -- LSU quarterback Jordan Jefferson and teammate Joshua Johns were released on $5,000 bond each Friday in connection with a bar fight that injured four people.

The two players turned themselves in after police obtained arrest warrants on felony charges of second-degree battery, stemming from their alleged roles in a fight outside Shady's bar in Baton Rouge on Aug. 19. The players have also been suspended indefinitely by the school.

Report: UConn starting corner stabbed to death

Absolutely horrific news coming out of Storrs, CT, this morning as the Hartford Courant is reporting that starting UConn cornerback Jasper Howard died following an on-campus stabbing.  He was 20 years old.

State Police major crime unit and UConn police say the stabbing happened just after 12:30 a.m. Sunday on Hillside Road near the center of campus. Police said two people were stabbed and were found near each other on Hillside Road. Both were taken by UConn ambulances to Windham Community Memorial Hospital. Police said the stabbing happened when a school-sponsored dance at the student union was let out. A fire alarm was pulled at 12:26 a.m., an altercation happened outside the building between two groups of people and then two people were stabbed.

The perpetrator of the stabbing is still at large, according to an emergency alert posted on the University’s website Sunday morning.

Our condolences go out to the family, friends and teammates of Jasper Howard.

EUGENE -- Oregon football player ------------------- spent a night in jail after being arrested Monday night in Springfield on a charge of felony assault.

After reviewing details of the incident Tuesday, the Lane County district attorney’s office elected not to file charges against ----------------. He was released from the Lane County Jail late Tuesday afternoon, cleared of any wrongdoing.
According to the Springfield Police’s public log of Montgomery’s incident, officers arrived at the Pacific Village Apartment complex on Gateway St. at 5:20 p.m. Monday after receiving a complaint of a “physical dispute” between a man and a woman.

Walk-on defensive end --------------, a veteran practice player for the Ducks, has been dismissed from the team. -------------- was charged with assault over the weekend for allegedly hitting a man ------------- believed was involved in the beating of UO kicker -------------- a week earlier.
